1. Acceptance of Terms

By accessing or using the website at https://thepracticeengine.com.au (the "Site") or engaging the services of The Practice Engine ABN [ABN to be inserted] ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site or our services.

2. Services

The Practice Engine provides specialist healthcare practice marketing services including, but not limited to: Search Engine Optimisation (SEO), Google Ads management, content marketing, email marketing, social media management, website design, brand design, AI automation, Fractional CMO services, and AI Visibility / Answer Engine Optimisation (AEO).

The specific services, deliverables, timelines, and fees applicable to your engagement will be set out in a separate Service Agreement or Statement of Work signed by both parties.

3. Free Strategy Session

The free 30-minute Practice Growth Strategy Session is offered at no cost and without obligation. We reserve the right to decline or reschedule sessions at our discretion. The session is intended for healthcare practice owners and managers actively considering marketing support.

4. 90-Day Results Guarantee

Our 90-Day Results Guarantee applies to growth-focused service engagements as defined in your Service Agreement. "Measurable growth" means a documented improvement in an agreed key performance indicator (KPI) such as website enquiries, new patient bookings, or search rankings within 90 days of campaign launch.

If the agreed KPI is not met within 90 days, we will continue to provide services at no additional charge until the KPI is achieved, subject to the client fulfilling their obligations under the Service Agreement (including timely approvals, content provision, and payment of fees).

The guarantee does not apply where underperformance is caused by factors outside our control, including but not limited to: algorithm changes, AHPRA enforcement actions against the client, client-directed strategy changes, or failure to implement our recommendations.

5. AHPRA Compliance

All marketing materials produced by The Practice Engine are reviewed for compliance with the AHPRA Advertising Guidelines and the Health Practitioner Regulation National Law. However, the registered health practitioner or practice owner remains ultimately responsible for ensuring all advertising complies with applicable laws and regulations.

We will not knowingly produce content that breaches AHPRA advertising requirements. If a client requests content we believe is non-compliant, we will advise accordingly and may decline to produce it.

6. Intellectual Property

All content on the Site including text, graphics, logos, images, and software is the property of The Practice Engine or its licensors and is protected by Australian and international copyright laws.

Upon full payment of fees, clients receive a licence to use the deliverables produced for them under their Service Agreement. Ownership of underlying tools, templates, and methodologies remains with The Practice Engine unless otherwise agreed in writing.

7. AI Assistant Disclaimer

The AI chat assistant (Rachel) on this Site is provided for general informational purposes only. Responses are generated by an artificial intelligence system and may not always be accurate, complete, or up to date. Rachel's responses do not constitute professional marketing, legal, medical, or financial advice.

Do not share sensitive personal health information, financial account details, or passwords in the chat widget. We are not responsible for any reliance placed on information provided by the AI assistant.

8. Limitation of Liability

To the maximum extent permitted by law, The Practice Engine's total liability to you for any claim arising from your use of the Site or our services is limited to the fees paid by you in the 3 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising from your use of the Site or our services.

9. Governing Law

These Terms are governed by the laws of NSW, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.
